General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (“Terms”) apply to all orders placed by consumers through the Leverium online store operated by:

Hereinafter referred to as the “Seller”, “Leverium”, “we”, “us” or “our”.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Contracting Party and Conclusion of Contract

The purchase contract is concluded with Levera UG (haftungsbeschränkt).

The presentation of products in our online store does not constitute a legally binding offer. It is an invitation to place an order.

You may place the selected products in your shopping cart and review or modify your selection before submitting the order.

By clicking the final order button, you submit a binding order for the products contained in your shopping cart.

After submitting the order, you will receive an automatic email confirming that we have received your order. This acknowledgement of receipt does not in itself constitute acceptance of your order.

The purchase contract is concluded when we accept your order by sending a shipping confirmation or by dispatching the goods, whichever occurs first.

If we do not accept an order, any payment already received for that order will be refunded without undue delay.

3. Order Process and Correction of Errors

Before submitting your order, you can review the products in your shopping cart, the quantities selected, the delivery address, the selected shipping method and the total price.

You can correct input errors using the functions provided in the online store or by returning to the relevant previous step before submitting the order.

The order becomes binding when you click the final order button indicating that the order involves an obligation to pay.

4. Processing and Delivery Times

Orders are generally processed within 1–3 business days after the order has been received and, where applicable, payment has been confirmed.

Estimated total delivery times, including normal processing time, are generally:

• Germany: 5–7 business days

• European Union: 5–12 business days

• United Kingdom: 7–14 business days

• United States, Canada, United Arab Emirates and other international destinations: 10–25 business days

These timeframes are general estimates. A different delivery estimate may apply depending on the destination, product availability, selected shipping service, local delivery partner and any applicable customs or import processing.

Where a more specific delivery estimate is displayed on the relevant product page or during checkout, that estimate takes precedence for the respective order.

Business days generally exclude Saturdays, Sundays and public holidays applicable at our place of business in Germany. Public holidays in the destination country may also affect delivery times.

Unless a binding delivery date has been expressly agreed, stated delivery times are estimates.

Customs procedures, local import requirements, unusually high order volumes, severe weather, carrier disruptions or other circumstances outside our reasonable control may result in additional delays.

If a product is unexpectedly unavailable or a significant delay occurs, we will inform you as soon as reasonably possible. Your mandatory statutory rights remain unaffected.

5. Prices, Taxes and Shipping Costs

The prices displayed for your selected market and delivery destination apply.

Prices may vary between countries or regions due to differences in taxes, shipping, import handling, currency conditions and other market-specific factors.

Prices include applicable VAT or similar consumption taxes where required by the law of the selected market, unless clearly stated otherwise.

Standard shipping is generally included in the displayed product price in many of our supported markets. However, shipping conditions may vary depending on the destination, delivery address, products and quantities ordered, order value, selected shipping method, carrier availability and local import or delivery requirements.

For certain destinations, orders or delivery methods, an additional shipping charge may therefore apply.

Optional express delivery and other additional delivery services, where available, may also incur an additional charge.

Any applicable shipping charge will be clearly displayed during checkout before you submit your order.

For deliveries outside the European Union, customs duties, import taxes, clearance fees, brokerage fees or similar charges may apply. Depending on the destination and delivery arrangement, these charges may be included in the displayed price, collected during checkout or payable separately by the recipient.

The applicable treatment will be communicated before the order is submitted.

The final total payable to us, including the product price, applicable taxes collected by us and any additional shipping charges, is displayed during checkout before you place the order.

You will always have the opportunity to review the final total before submitting an order with an obligation to pay. The conditions and total price displayed immediately before the order is submitted apply to that order.

6. Delivery and Available Markets

We deliver only to countries and regions that are available for selection and ordering through our online store.

Available destinations, products and delivery conditions may change as we expand or adjust our shipping network. The availability shown during checkout at the time of the order applies.

If a destination is not available during checkout, no order can currently be placed for delivery to that destination unless we expressly agree otherwise.

Orders are delivered to the shipping address provided during checkout. You are responsible for ensuring that the delivery information is complete and accurate.

Available shipping methods and estimated delivery times may vary by destination. The applicable information is provided in our Shipping Policy, on the relevant product or shipping information page, or during checkout.

Unless a binding delivery date has been expressly agreed, stated delivery times are estimates. Customs processing, local import requirements, carrier delays or other circumstances outside our reasonable control may affect international delivery times.

If delivery becomes impossible or is significantly delayed, we will inform you where reasonably possible. Your mandatory statutory rights remain unaffected.

7. Payment

Payment can be made using the payment methods offered during checkout.

Available payment methods may vary depending on the selected market, currency and delivery destination.

Unless otherwise stated for a particular payment method, the purchase price is due when the purchase contract is concluded.

Payment processing may be carried out by an external payment service provider. Any additional terms of that provider will apply only to the payment service concerned and will not limit your statutory rights against us.

8. Retention of Title

The goods remain our property until full payment has been received.

9. Statutory Right of Withdrawal

Where applicable, consumers have a statutory right of withdrawal.

Information about the conditions, deadlines, procedure, consequences and any applicable exceptions is provided in our Refund & Return Policy, including the statutory withdrawal information and model withdrawal form.

The statutory right of withdrawal is separate from any voluntary Satisfaction Guarantee offered by us.

10. Voluntary 30-Day Satisfaction Guarantee

In addition to applicable statutory rights, Leverium offers a voluntary 30-Day Satisfaction Guarantee for eligible products purchased directly through our online store.

The guarantee allows eligible products to be opened and reasonably used for evaluation, subject to the conditions of the guarantee.

The guarantee provider, eligible products, territorial scope, time limits, return procedure, refund terms and exclusions are set out in our Refund & Return Policy applicable at the time of purchase.

The voluntary Satisfaction Guarantee does not affect or restrict any statutory rights, including rights of withdrawal and rights relating to defective or non-conforming goods.

11. Statutory Rights for Defective or Non-Conforming Goods

Statutory rights relating to defective or non-conforming goods apply without restriction.

If a product is defective, damaged during shipping or different from what was ordered, please contact us at hello@leverium.skin so that we can review the matter and provide appropriate instructions.

Any voluntary guarantee or goodwill arrangement is additional to and does not replace these statutory rights.

12. Liability

We are liable without limitation:

• for damages resulting from injury to life, body or health;

• for damages caused intentionally or through gross negligence;

• where we have fraudulently concealed a defect;

• where we have expressly provided a guarantee covering the relevant damage; and

• where liability is mandatory under applicable law, including applicable product liability law.

In cases of slight negligence involving the breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for the contract.

An essential contractual obligation is an obligation whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the customer may normally rely.

To the extent permitted by law, liability for slight negligence is otherwise excluded.

Mandatory consumer rights and other mandatory statutory liability remain unaffected.

13. Information Regarding Cosmetic Products

Our cosmetic products are intended for external use only unless expressly stated otherwise.

Please follow the directions, precautions and product information provided with the respective product.

Ingredients are listed on the product packaging and, where available, on the relevant product page. If you have a known sensitivity or allergy to an ingredient, you should review the ingredient list before use.

Individual skin reactions and tolerability may vary. Discontinue use if significant irritation or another unexpected reaction occurs and seek appropriate professional advice where necessary.

If you have concerns relating to an existing skin condition, pregnancy, medication or medical treatment, seek appropriate professional advice before use.

Our cosmetic products are not intended to diagnose, treat, cure or prevent disease.

Nothing in this section limits our legal obligations regarding product safety or your statutory rights.

14. Consumer Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless participation is required by applicable law.

15. Governing Law

These Terms and the contractual relationship between you and us are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer whose habitual residence is outside Germany, this choice of law does not deprive you of the protection provided by mandatory provisions of the law that would apply without this choice of law.

16. Final Provisions

If an individual provision of these Terms is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions remains unaffected.

The applicable statutory provisions will apply in place of any invalid or unenforceable provision.
